Section 14
Registration of design
: (1) If an application is received by someone according to section 13, the department should register the design in the name of the applicant and issue a certificate as per schedule-2(b). However, such a design will hurt the reputation of a person or organization, or will have a bad effect on the morality or ethics of the general public, or will be detrimental to the national interest, or if the design has already been registered in someone else's name, it will not be registered according to this subsection.
(2) In order to obtain the certificate as per sub-section (1), the applicant must file the registration of the design as specified in (b) of Schedule-3 (2) in the Customs Department.
(3) The department may cancel the registration of a design if it finds that there is any condition written in the restrictive phrase of sub-section (1). However, before canceling the registration of a design, the department must give the designer a reasonable opportunity to show if there is any reason why the registration of the design should not be cancelled.
